  22. Section 17.11 Endangered and threatened wildlife.
  23.  
  24.  
  25.     (a) The list in this section contains the names of all species of
  26. wildlife which have been determined by the Services to be Endangered or
  27. Threatened.  It also contains the names of species of wildlife treated as
  28. Endangered or Threatened because they are sufficiently similar in
  29. appearance to Endangered or Threatened species (see Section 17.50 #et
  30. seq^.).
  31.  
  32.     (b) The columns entitled "Common Name," "Scientific Name," and
  33. "Vertebrate Population Where Endangered or Threatened" define the species
  34. of wildlife within the meaning of the Act.  Thus, differently classified
  35. geographic populations of the same vertebrate subspecies or species shall
  36. be identified by their differing geographic boundaries, even though the
  37. other two columns are identical.  The term "Entire" means that all
  38. populations throughout the present range of a vertebrate species are
  39. listed.  Although common names are included, they cannot be relied upon for
  40. identification of any specimen, since they may vary greatly in local usage.
  41.  
  42. The Services shall use the most recently accepted scientific name.  In
  43. cases in which confusion might arise, a synonym(s) will be provided in
  44. parentheses.  The Services shall rely to the extent practicable on the
  45. #International Code of Zoological Nomenclature.^
  46.  
  47.     (c) In the "Status" column the following symbols are used: "E" for
  48. Endangered, "T" for Threatened, and "E [or T] (S/A)" for similarity of
  49. appearance species.
  50.  
  51.     (d) The other data in the list are nonregulatory in nature and are
  52. provided for the information of the reader.  In the annual revision and
  53. compilation of this title, the following information may be amended without
  54. public notice: the spelling of species' names, historical range, footnotes,
  55. references to certain other applicable portions of this title, synonyms,
  56. and more current names.  In any of these revised entries, neither the
  57. species, as defined in paragraph (b) of this section, nor its status may be
  58. changed without following the procedures of Part 424 of this title.
  59.  
  60.     (e) The "historic range" indicates the known general distribution of
  61. the species or subspecies as reported in the current scientific literature.
  62. The present distribution may be greatly reduced from this historic range. 
  63. This column does not imply any limitation on the application of the
  64. prohibitions in the Act or implementing rules.  Such prohibitions apply to
  65. all individuals of the species, wherever found. 
  66.  
  67.     (f)(1) A footnote to the Federal Register publication(s) listing or
  68. reclassifying a species is indicated under the column "When listed."
  69. Footnote  numbers to Sections 17.11 and 17.12 are in the same numerical
  70. sequence, since plants and animals may be listed in the same Federal
  71. Register document.  That document, at least since 1973, includes a
  72. statement indicating the basis for the listing, as well as the effective
  73. date(s) of said listing.
  74.  
  75.     (2) The "Special rules" and "Critical habitat" columns provide a cross
  76. reference to other sections in Parts 17, 222, 226, or 227.  The "Special
  77. rules" column will also be used to cite the special rules that describe
  78. experimental populations and determine if they are essential or
  79. nonessential.  Separate listing will be made for experimental populations,
  80. and the status column will include the following symbols: "XE" for an
  81. essential experimental population and "XN" for a nonessential experimental
  82. population.  The term "NA" (not applicable) appearing in either of these
  83. two columns indicates that there are no special rules and/or critical
  84. habitat for that particular species.  However, all other appropriate rules
  85. in Parts 17, 217 through 227, and 402 still apply to that species.  In
  86. addition, there may be other rules in this title that relate to such
  87. wildlife, e.g., port-of-entry requirements.  It is not intended that the
  88. references in the "Special rules" column list all the regulations of the
  89. two Services which might apply to the species or to the regulations of
  90. other Federal agencies or State or local governments.
  91.  
  92.     (g) The listing of a particular taxon includes all lower taxonomic
  93. units.  For example, the genus #Hylobates^ (gibbons) is listed as
  94. Endangered throughout its entire range (China, India, and SE Asia);
  95. consequently, all species, subspecies, and populations of that genus are
  96. considered listed as Endangered for the purposes of the Act.

  454.     (a) The list in this section contains the names of all species of
  455. plants which have been determined by the Services to be Endangered or
  456. Threatened. It also contains the names of species of plants treated as
  457. Endangered or Threatened because they are sufficiently similar in
  458. appearance to Endangered or Threatened species (see Section 17.50 #et
  459. seq^.)(b) The columns entitled "Scientific name" and "Common name" define
  460. the species of plant within the meaning of the Act.  Although common names
  461. are included, they cannot be relied upon for identification of any

  468.     (c) In the "Status" column the following symbols are used: "E" for
  469. Endangered, "T" for Threatened, and "E [or T] (S/A)" for similarity of
  470. appearance species.
  471.  
  472.     (d) The other data in the list are nonregulatory in nature and are
  473. provided for the information of the reader.  In the annual revision and
  474. compilation of this title, the following information may be amended without
  475. public notice: the spelling of species' names, historical range, footnotes,
  476. references to certain other applicable portions of this title, synonyms,
  477. and more current names.  In any of these revised entries, neither the
  478. species, as defined in paragraph (b) of this section, nor its status may be
  479. changed without following the procedures of Part 424 of this title.
  480.  
  481.     (e) The "Historic range" indicates the known general distribution of
  482. the species or subspecies as reported in the current scientific literature.
  483.  
  484. The present distribution may be greatly reduced from this historic range. 
  485. This column does not imply any limitation on the application of the
  486. prohibitions in the Act or implementing rules.  Such prohibitions apply to
  487. all individuals of the plant species, wherever found.
  488.  
  489.     (f)(1) A footnote to the Federal Register publication(s) listing or
  490. reclassifying a species is indicated under the column "When listed."
  491. Footnote numbers to Sections 17.11 and 17.12 are in the same numerical
  492. sequence, since plants and animals may be listed in the same Federal
  493. Register document.  That document, at least since 1973, includes a
  494. statement indicating the basis for the listing, as well as the effective
  495. date(s) of said listing.
  496.  
  497.     (2) The "Special rules" and "Critical habitat" columns provide a cross
  498. reference to other sections in Parts 17, 222, 226, or 227.  The "Special
  499. rules" column will also be used to cite the special rules which describe
  500. experimental populations and determine if they are essential or
  501. nonessential.  Separate listings will be made for experimental populations,
  502. and the status column will include the following symbols: "XE" for an
  503. essential experimental population and "XN" for a nonessential experimental
  504. population.  The term "NA" (not applicable) appearing in either of these
  505. two columns indicates that there are no special rules and/or critical
  506. habitat for that particular species.  However, all other appropriate rules
  507. in Parts 17, 217 through 227, and 402 still apply to that species.  In
  508. addition, there may be other rules in this title that relate to such

  835. ATTACHMENT I -- SPECIES REMOVED FROM THE ENDANGERED AND THREATENED LISTS
  836.  
  837.     The Service's listing regulations at 50 CFR 424.11(c) and (d) are as
  838. follows:
  839.  
  840.     (c) A species shall be listed or reclassified if the Secretary
  841. determines, on the basis of the best scientific and commercial data
  842. available after conducting a review of the species' status, that the
  843. species is endangered or threatened because of any one or a combination of
  844. the following factors:
  845.  
  846.     (1) The present or threatened destruction, modification, or
  847. curtailment of its habitat or range;
  848.  
  849.     (2) Overutilization for commercial, recreational, scientific, or
  850. educational purposes;
  851.  
  852.     (3) Disease or predation;
  853.  
  854.     (4) The inadequacy of existing regulatory mechanisms; or
  855.  
  856.     (5) Other natural or manmade factors affecting its continued
  857. existence.
  858.  
  859.     (d) The factors considered in delisting a species are those in
  860. paragraph (c) of this section as they relate to the definitions of
  861. endangered or threatened species.  Such removal must be supported by the
  862. best scientific and commercial data available to the Secretary after
  863. conducting a review of the status of the species.  A species may be
  864. delisted only if such data substantiate that it is neither endangered nor
  865. threatened for one or more of the following reasons:
  866.  
  867.     (1) #Extinction.^  Unless all individuals of the listed species had
  868. been previously identified and located, and were later found to be
  869. extirpated from their previous range, a sufficient period of time must be
  870. allowed before delisting to indicate clearly that the species is extinct.
  871.  
  872.     (2) #Recovery.^  The principal goal of the U.S. Fish and Wildlife
  873. Service and the National Marine Fisheries Services is to return listed
  874. species to a point at which protection under the Act is no longer required. 
  875. A species may be delisted on the basis of recovery only if the best
  876. scientific and commercial data available indicate that it is no longer
  877. endangered or threatened.
  878.  
  879.     (3) #Original data for classification in error.^  Subsequent
  880. investigations may show that the best scientific or commercial data
  881. available when the species was listed, or the interpretation of such data,
  882. were in error.
  883.
